1. Who you are contracting with

Scene Magazine (the "Service") is owned and operated by Scene Media LLC, trading as Scene Magazine. When you use the Service or buy a subscription, you are contracting with Scene Media LLC ("we", "us", "our"). Contact: support@szenemagazine.com.

2. Acceptance

By accessing, browsing or continuing to use the Service, or by purchasing a subscription, you agree to these Terms and to our Privacy Notice. If you do not agree, stop using the Service. You confirm you are of legal age to enter this agreement and, if you act for a business or band, that you have authority to bind it.

3. The Service

Scene Magazine publishes live music, comedy and venue listings for South Florida. Free visitors can browse listings and opt in to text alerts. Paid subscribers ("Band Pro") get member tools such as band, musician and venue profiles, gig scheduling, the on-call availability board and listing promotion. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

4. Your account

You must provide accurate information and keep it up to date, keep your credentials confidential, and you are responsible for all activity under your account. Notify us promptly of any unauthorised use.

5. Acceptable use

You must not:

• use the Service unlawfully or for any fraudulent, deceptive or spam purpose;
• submit listings, images or text you do not have the rights to, or that infringe any third party's intellectual property, privacy or publicity rights;
• post content that is unlawful, harassing, hateful, defamatory or otherwise harmful;
• interfere with the security or integrity of the Service — no malware, probing, penetration testing, scraping, automated bulk data extraction, or circumventing technical limits or paywalls;
• reverse engineer, resell or redistribute the Service or its content.

6. Listings and user content

You retain ownership of the content you submit and grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting, and publish it in the magazine, schedule, text alerts and related promotion of the Service. You are responsible for the accuracy of gig dates, venues and contact details. Listings are moderated: we may approve, edit, decline or remove any listing at our discretion, and publication of public submissions is first come, first served and not guaranteed. Rights-holders can request removal by emailing support@szenemagazine.com; repeat infringers lose access.

7. Our intellectual property

We and our licensors retain all rights in the Service, including its software, design, database, editorial content, the Scene Magazine name and logo, and all associated intellectual property. Nothing in these Terms transfers ownership to you.

8. Payment, subscriptions and tax

Subscriptions are sold on a recurring basis (monthly or annual) at the prices shown on our Plans page in USD, and renew automatically at the end of each billing period until cancelled. Payment, billing frequency, currency conversion, invoicing, applicable sales tax or VAT, subscription changes, cancellations and refunds are governed by Paddle's Buyer Terms. You can cancel at any time from the billing page or the Paddle portal; access continues to the end of the period you have paid for. See our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Text alerts

Text alerts require confirmation of your mobile number. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help at any time.

10. Service level and warranties

We work to keep the Service available but do not guarantee uninterrupted or error-free performance, and listing information supplied by bands, venues and the public may be incomplete or change without notice. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

11. Liability

To the extent permitted by law, we are not liable for indirect, consequential, special or incidental damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability is limited to the fees you paid us in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

12. Indemnity

You will indemnify us against claims, losses and reasonable costs arising from content you submit, your unlawful use of the Service, or your breach of these Terms.

13. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination your listings may be removed and your right to use the Service ends; you may request an export of your listing data within 30 days, after which we may delete it in line with the Privacy Notice.

14. Changes to these Terms

We may update these Terms and will revise the date above. Material changes affecting paid subscriptions take effect at your next renewal.

15. General

These Terms are governed by the laws of the State of Florida, USA, and the state and federal courts located in Broward County, Florida have exclusive jurisdiction. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. If any provision is unenforceable, the rest remains in effect.
